Anyone who owns or manages an air conditioning system that is over 12Kw is responsible for obtaining an assessment of their operating conditions and ensuring that the air conditioning system receives a regular service, inspection and maintenance check. This inspection for 12Kw systems and above is mandatory and is enforced and regulated by the legislation laid down in Article 9 of the Energy Performance of Buildings (Certificates and Inspections) Regulations 2007.

 

It states that owners and companies need to employ a certified independent professional to inspect their air conditioning on a regular basis.

 

Trading Standards are the body held responsible for enforcing these regulations and - as a regulatory authority - they can issue penalty charges if regulations are not complied with.

 

Therefore it is important that all the requirements are met and a TM44 report provided where necessary.

 

The Energy Performance of Buildings (Certificates and Inspections) (England and Wales) Regulations 2007

For those who own, manage or control air conditioning systems in the 12 Kw or above category, they need to ensure that applicable systems are inspected every five years by an independent and suitably accredited company.

 

For those who have recently moved and have acquired premises with existing air conditioning, you will need a TM44 inspection within three months of occupation.

 

This inspection should produce an assessment TM44 report that will specify the details of any work, maintenance, servicing and repairs undertaken to that particular system.

 

All inspections need to be carried out by an accredited Air Conditioning Energy Assessor and all reports must comply with the rules detailed in the TM44 report.
